Appeals
If an error occurred in your trial or administrative hearing it is important to act quickly to get the error resolved as there are typically time limits on filing an appeal. Appellate law involves direct appeals of criminal convictions, civil judgments, and administrative hearings that have been resolved at the trial or hearing level. Post-conviction relief is available for criminal defendants convicted as the result of errors or injustices that do not appear in the trial record and therefore cannot be raised on direct appeal. Mark has worked for several appellate court judges over the course of his legal career and participated in the drafting of many appellate court opinions. This experience allows Mark to better prepare a strategy for your appeal and better predict whether an appeals court will agree that an error exists that requires reversal. Depending on your unique legal situation, Mark can generally represent you on an appeal for a flat fee.
General Litigation
Mark has represented individuals and businesses seeking to assert or defend their legal rights in the common pleas and probate courts of Ohio on various civil legal matters. Litigation -- by its nature -- is a costly endeavor. Mark's primary goal in litigating your case is to clearly define your goals. Your goals are Mark's primary focus whether you have been sued or intend to sue another party. After identifying your goals, Mark will devise a sound litigation strategy to achieve those goals in a manner that conforms to your budget. Mark has found that client participation in the litigation process can make or break a case. He therefore expects his clients to take an active role in their case.
Elder Fraud
Through out this country, financial fraud upon the elderly is becoming commonplace. Alzheimer's, dementia, and other diseases creating diminished capacity cause those affected members of our older community to be susceptible to the undue influence of caretakers, family members, neighbors, and even complete strangers. Those with diminished capacity rely on others to help them manage their financial lives. Unfortunately, some choose to take advantage of this situation. On cases of elder fraud, Mark works hand in hand with Craig T. Matthews, an attorney in Dayton, Ohio. Mr. Matthews has decades of experience representing the elderly or their families in cases of financial fraud. Together, Mark and Mr. Matthews have successfully represented individuals who have lost hundreds of thousands of dollars in cases of elder fraud. Contact the Law Office of Mark W. Evans if you suspect that you or a loved one has been a victim of elder fraud.
Estate and Probate Administration
If a loved one has passed on, you may need legal assistance in settling their "estate" in the probate court. An estate consists of all of your loved one's assets as well as their debts. "Administering" an estate in the probate court is a sometimes complex process. It involves making and filing an inventory of the estate, appraising estate assets, selling estate assets, paying debts, and distributing estate assets to beneficiaries. If you have never administered an estate before, you may find it to be a burdensome, time consuming, and confusing process. Mark will help steer you through this process while minimizing the legal costs to you or the Estate.
Simple and Complex Estate Planning
Few realize how important it is to plan for what happens when you pass on. Something as simple as a will can avoid numerous and costly problems that your family could face after your death. Proper estate planning provides for the protection of your legal and monetary interests and can ensure that your loved ones are provided for in a manner that you have devised. Mark is ready to help you if you need assistance with the creation of wills, healthcare advanced directives, powers of attorney, and simple trusts, all for affordable flat fees.
Business Planning
Mark advises clients on creating business entities to safeguard their personal assets. For a flat fee, Mark provides sound legal advice on establishing a new business or transforming your current business. Mark will also provide all necessary documentation to help you set up and run your new or existing business.
